One of the inescapable facts of people living longer than may have been the case with previous generations is that either mental capacity, or physical ability, or both could decline and it may well be the case that individuals are unable to deal with their financial affairs.
We can help you with the selection of appropriate persons to act as attorneys and we can draft Lasting Powers of Attorney for property and financial matters or for health and welfare matters, or both. We can also draft business specific Lasting Powers of Attorney if you are a shareholder of a private limited company and would wish operation of that entity to be controlled by different attorneys.
We can register Lasting Powers of Attorney whether made here or elsewhere and we are also able to effect registration of the older Enduring Powers of Attorney.
Where there is already insufficient capacity to make a Lasting Power of Attorney, we can assist with a Court of Protection Deputyship application. Where necessary, we are happy to act as a professional deputy and prepare annual deputy accounts and reports as required by the Court of Protection. We are also versed in applying for and opposing Statutory Will applications for, or by, those who lack mental capacity to make a new Will but for whom a new Will may be desired for a variety of reasons.
